Federal Motor Carrier Administration’s Comprehensive Safety Analysis 2010

The continuing problem with unsafe trucks and deadly truck accidents on the nation’s highways has prompted the Federal Motor Carrier Safety Administration to develop a new program to identify truckers and trucking companies that aren’t complying with safety rules.

Comprehensive Safety Analysis 2010 makes new use of inspection and crash results to spotlight large commercial motor carriers and drivers whose behaviors could lead to crashes. One out of nine traffic deaths in 2008 resulted from a collision involving a large truck, according to federal data. So much remains to be done to make the roads safe from dangerous truck drivers.

Have you been the victim of a serious truck accident? The Pennsylvania injury and accident lawyers at Munley, Munley & Cartwright, P.C., fight to hold truckers and trucking companies accountable for the harm they cause by negligent or reckless driving. If you or a loved one has been hurt by the carelessness of a truck driver, call us today at 877-421-9175, or use our online form.

At Munley, Munley & Cartwright P.C., we closely follow the development of safety rules for the commercial trucking industry. Our knowledge of those rules gives us an advantage in helping clients seriously injured by dangerous drivers and unsafe trucks.

Federal Motor Carrier Safety Regulations (FMCSR) apply to commercial motor vehicles, which generally include any large truck that weighs more than 10,000 pounds such as an 18-wheeler or tractor trailer. Vehicles used to haul hazardous materials also are included. In 2008, 380,000 large trucks were involved in traffic crashes in the United States, and more than 4,000 were involved in fatal accidents. Many of these accidents were preventable.

To reduce serious and fatal truck accidents, the Federal Motor Carrier Safety Administration is introducing a state-by-state program in 2010 to measure safety performance in new ways. The program uses inspection and crash results to pinpoint truck drivers and carriers whose behavior could cause crashes. The new CSA Safety Measurement System will use all roadside inspections, including all safety violation, state-reported crash data and federal motor carrier census to identify specific safety problems by a carrier or driver and monitor whether the problems are improving or getting worse.

The Safety Measurement System quantifies performance in a number of categories including unsafe driving, fatigued driving, impaired driving, poor vehicle maintenance, improper loading, lack of training or medical fitness, and frequency of crashes. Drivers will be assigned scores based on their performance. An experienced truck accident lawyer at Munley, Munley & Cartwright, P.C. can analyze a carrier’s record and use poor scores and rankings as strong evidence of a pattern of negligent behavior that led to a accident.

For years, the National Transportation Safety Board has urged the Federal Motor Carrier Safety Administration to mandate additional safety measures to remove dangerous truckers from the highways. The recommendations, which have yet to be fully adopted, include an improved medical certification process to weed out medically-unfit drivers and rules to require industry-wide use of electronic on-board recorders or black boxes for all 18-wheelers. Much remains to be done to improve trucking safety, and by holding accountable negligent truckers and trucking companies responsible for serious accidents, we help bring attention to the problems.
