Delaware Trucking Laws and Regulations
The federal government restricts the size and weight of trucks that can travel on the National System of Interstate and Defense Highways. Trucks are limited to:
-
80,000 pounds for the gross weight of a vehicle,
-
20,000 pounds for a single axle, or
-
34,000 pounds for a tandem axle.
However, states have the option of issuing permits allowing overweight or oversized vehicles to travel on these highways or any other roads.
In Delaware, truck companies can apply for permits to move superloads: vehicles up to 15 feet in width, 120 feet in length or 15 feet in height. No superload can weigh over 120,000 pounds. Permits are issued for three or four axle vehicles that are legal on other roads in Delaware. The permits are good for three days, and only for a single trip. Travel must take place Monday-Friday, between sunrise and sunset. In addition, permits are not issued for a number of holidays: New Year's, Memorial Day, Independence Day, Thanksgiving and Christmas.
The Federal Motor Carrier Safety Administration requires that all trucks carry insurance: a minimum of $750,000 liability insurance, $500,000 cargo insurance, and a $10,000 bond. In Delaware, trucks must carry this 750/500/10 formula; as well, insurance must be on file in the amounts of 100/300/50.
